Today, CBD is readily available online with CBD products ranging from CBD oils to CBD Sparkling Water, but is it legal? Well, this was a hard question to pick apart.
In many countries, CBD is in a bit of a grey area, it’s not illegal, but it’s often not legal either. In countries where THC (the psychoactive ingredient in cannabis) is illegal, for example in the UK, most of Europe, Australia, and NZ, CBD is often legal when containing around 0.3% or less of THC, and mostly even then you need a prescription for it.
The USA is a more complicated story. Most growers refer to the 2014 Farm Bill, which allows people to grow Hemp for research purposes. This is where the DEA start to turn a blind eye, they say that while growing Hemp in these states is legal (for research purposes only), it’s still technically illegal to sell the product and that people who are selling are misconstruing the law.
• What is CBD Oil and does it work?
Currently, 40 states have passed legislation of pilot programs for growing Hemp, 19 have active programs and 10 states consider it illegal.
Basically, if you want to purchase CBD oil legally in the USA, you need to check the label to see if it says ‘Farm Bill Hemp’ to ensure it’s coming from one of those 19 active programs, if it's from outside of those programs, technically you'll be breaking the law.
Outside of the USA you will need to look into your countries laws surrounding CBD restrictions. Some countries offer homegrown brands and others it is legal to import from overseas suppliers, regardless, it’s often still an unclear statement.
